In a meeting with the Department of Health which took place in September 2014, Brain Injury Case Manager and Social Worker Mark Holloway presented the findings and recommendations of the group. These are included in a comprehensive new report, which will be used to assist the Department of Health and the House of Lords Select Committee into the MCA in implementing these important changes.
The report identifies:
- A number of actions that will support the MCA steering group to put forward changes to meet the recommendations made by the House of Lords Select Committee and reduce the difficulties presently encountered by those using or subject to the Act.
- The role of the Brain Injury Rehabilitation Trust's (BIRT) Brain Injury Needs Indicator (BINI) in evidencing brain injury during an adult social care assessment. The tool is presently being piloted by local authorities.
- A number of real-life examples of the use of the MCA and 'on the ground' difficulties experienced by service users, their families and health and social care professionals.
- A referenced outline of where people with an acquired brain injury may encounter services and/or difficulties with decision-making, whether they have or lack capacity.
- The role and difficulties encountered by social workers and others in relation to their role using the MCA with people with an ABI.
- Collated and appends the references to acquired brain injury within the House of Lords report and from the published evidence and matches those with our recommendations.
